Building our company leadership to support Bridgeford Trust Company’s rapid growth in the international space, Helmer Arizmendy has joined the Bridgeford Team to lead Bridgeford International as President focusing on Bridgeford’s worldwide expansion, with a focus on Latin American (LATAM) countries. Helmer is also joining Bridgeford Trust Company as a member of the Board of Managers and Trust Administrative Committee and Bridgeford Advisors dba Bridgeford as Senior Managing Director.

Prior to joining Bridgeford’s family of companies, Helmer had an impressive history of delivering value-added and comprehensive wealth structuring solutions around the world through senior positions held at Citi Private Bank, UBS AG, Northern Trust, and Lombard International. In these roles, he was responsible for business development in LATAM countries, launching Miami operations, and expansion of private placement life insurance (PPLI) capabilities, while restructuring clients’ wealth within tax efficient vehicles and providing sophisticated tax and asset protection solutions.

As we continue to brace for potentially significant changes in the tax arena, South Dakota’s Community Property Special Spousal Trust remains a very powerful state income and estate tax planning tool. This very progressive tax concept, only available in three states, allows married settlors of the trust to avoid state taxation on undistributed retained income within the trust since South Dakota does not have an income tax. In addition, and equally compelling, trust assets are treated as community property at the death of the first spouse, applying a 100% step-up in basis at date of death, therefore, avoiding federal capital gains taxation of marital/trust assets in a subsequent sale.

The South Dakota Family Advisor is another modern trust law tool that delivers far more control to settlors of trusts, beneficiaries, and their advisors than ever before when used in conjunction with a directed trust. South Dakota is the only state in the nation to have enacted progressive new legislation, statutorily creating the South Dakota Family Advisor.

The Family Advisor role is similar to the Trust Protector and is referred to as “Trust Protector Light” because of its non-fiduciary status and limited powers. It is an excellent option for settlors of trusts and beneficiaries who may want family advisors – such as attorneys, CPAs, or investment advisors – to have the power to modify, control, and participate in many important aspects of trust administration without elevating the position to that of a fiduciary, which carries with it heightened liability that may deter advisors from serving.
